Austin ORDINANCE NO. 9430 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE TWO TRACTS OF LAND LOCATED IN THE 1200 BLOCK OF NORTHTOWNE LANE AND THE 5200 BLOCK OF AUSTIN ROAD, BEING ON THE NORTHEAST LINE OF NORTHTOWNE LANE NORTHEAST OF HIGHWAY 153, AND ON THE SOUTHWEST LINE OF AUSTIN ROAD AT OLD HIXSON PIKE FROM R-2 RESIDENTIAL ZONE AND R-3 RESIDENTIAL ZONE TO C-2 CONVENIENCE COMMERCIAL DISTRICT, SUBJECT TO CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: Two tracts of land located in the 1200 block of Northtowne Lane and the 5200 block of Austin Road, being on the northeast line of Northtowne Lane northeast of Highway 153, and on the southwest line of Austin Road at Old Hixson Pike. Tract 1: Part of a tract shown as "Future Development," Northtowne Center Subdivision, as shown by plat of record in plat book 46, page 7, R.O.H.C. Said part of tract begins on the northeast line of Northtowne Lane 1352 feet northeast, then southeast, of the intersection of the northwest line of Northtowne Lane with the northeast line of Highway 153, thence southeast some 374 feet, thence southwest some 188 feet to the northeast line of Northtowne Lane, thence northwest 327.66 feet with Northtowne Lane to the point of beginning. Tract 2: An unplatted tract beginning at the intersection of the southwest line of Austin Road with the northwest line of Old Hixson Pike, thence southwest 300 feet with Old Hixson Pike to the present C-2 zoning line, thence northwest some 1050 feet with said zoning line, thence northeast some 60 feet, thence northwest some 113 feet, thence northeast some 321.37 feet to the southwest line of Austin Road, thence southeast some 1180 feet with Austin Road to the northwest line of Old Hixson Pike, the point of beginning. from R-2 Residential Zone and R-3 Residential Zone to C-2 Convenience Commercial District. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 1. Approval of access by the City Traffic Engineer. 2. Dedication of the right-of-way for an additional lane on Austin Road as required by the City Traffic Engineer. 3. All existing easements are retained. SECTION 3.
